Bixby U.S. Privacy Notice

Samsung Electronics Co., Ltd., along with our affiliates and subsidiaries (collectively, “Samsung”) respects your concerns about privacy. This Bixby Privacy Notice applies to the personal information we obtain through Bixby (“Bixby”). Unless otherwise stated herein, this Privacy Notice applies to your use of Bixby associated with the Samsung account you use to sign in to Bixby and any devices listed here (click on "The New Bixby") that you use to sign in to Bixby using that same Samsung account. It does not apply to information collected by other apps, websites or services provided by Samsung. If you are a minor, please refer to our Bixby U.S. U.S. Privacy Notice for MinorsPrivacy Notice for Minors with a parent or guardian, which will help you understand better what information we collect and how we use it.

This Privacy Notice supplements the Samsung Privacy Policy (available at https://www.samsung.com/us/account/privacy-policy) (“Samsung Privacy Policy”) and provides additional information about how we may collect, use and share your personal information in connection with Bixby. In the event any portion of this Privacy Notice conflicts with the Samsung Privacy Policy, the relevant provisions of this Privacy Notice will govern.

You will need to agree to the Bixby Privacy Notice before you can activate Bixby, and before we can collect and use your voice information. If you consent to the Bixby Privacy Notice, we will still only collect voice information if you activate Bixby.

You can activate Bixby in many ways. For example, on displays, you can say "Hi Bixby" or press the invoke button on each device. The status indicator on your device, such as an on-screen indicator or flashing LEDs on top of your device, lets you know when Bixby is activated.

Information We Obtain

Through Bixby, we may obtain information about you in various ways.

Information You Provide Directly

Bixby collects information from you directly. For example, when you create a Samsung account to use Bixby, we ask for your name, date of birth, gender, phone number, and email address.

Information We Obtain by Automated Means

In addition to the information you provide, we collect information about your use of Bixby through the software on your devices and by other means. We collect:

• Bixby interactions: We collect the information you exchange with Bixby through your interactions with Bixby, including recordings of your wake-up command and voice commands (such as your questions, requests, and instructions), your touch interactions and other inputs (such as the hints you tap in Bixby), and the information you receive from Bixby (such as responses, answers, and content). If you submit information to Bixby that is sensitive in nature (such as health information), that will also be collected and processed for the purposes set out below. We will not actively ask you for or collect such sensitive information in connection with your use of Bixby. We also may obtain other information related to your use of Bixby, including information we receive from Samsung and third-party apps and services that are accessed or used by you as part of the Bixby commands you make (such as social media, email, and instant messaging apps). The information we receive will depend on the voice commands made in Bixby, and includes, without limitation, information related to the apps you use, the websites you visit and your contact lists, music, calendar entries, bookmarks, notes, call logs, alarm clock, registered device lists within Samsung apps, and content and data from other Samsung and third-party apps, websites, and services.

• Bixby settings: Your Bixby settings will be collected, such as the language, voice style, voice wake-up data, which services (services are third-party software that link with Bixby to bring you additional features) you have allowed to access your information, voice responses, listen automatically, provide sound feedback, and use while the mobile device is locked.

• Device and app information: Your hardware model, device hardware information, IMEI number and other unique device identifiers, current software version, MCC (Mobile Country Code), MNC (Mobile Network Code), MAC address, IP address, operating system versions, and settings of the devices you use to access Bixby. In addition, we obtain information about how, when, and for how long you use your Bixby-enabled devices (including Samsung and third-party devices you control with Bixby), including response to wake-up commands, as well as your usage of Bixby and Samsung and third-party apps and services on the devices (such as a list of the apps on your devices).

• Location information: Location information about nearby Wi-Fi access points and cell towers, and with your separate consent geolocation, will be transmitted to us when you use Bixby and enable the Location function.

• Read-aloud content: Bixby provides a read aloud feature, which allows you to request certain content from your mobile device, for example your messages, notifications, or emails, to be read aloud. When you ask Bixby to read content aloud, that content will be collected and processed to provide you with the read aloud feature. Collected content will be deleted once Bixby has read the content aloud. We will ask for your separate consent before collecting content for the read aloud feature.

We also may collect other information about you, your devices and apps, and your use of the Bixby in ways that we describe to you at the time of collection or otherwise with your consent.

How We Use the Information We Obtain

We may use the information we obtain through the Bixby as described in the Samsung Privacy Policy and below. We will only use your information for these purposes.

• To help you or your device register for Bixby;

• To provide Bixby or features you request, including allowing you to interact with and use participating third-party apps and services;

• To use your device’s geolocation to carry out and provide better responses to your audio commands and certain features, such as Personalized Bixby;

• To allow you to use your wake-up command to wake-up Bixby and filter your voice against other people’s voices and background noise, which occurs within your device, as well as save your registered wake-up command from one device to restore it on another. Wake-up commands are retained until you choose to delete them, which you can do at any time in the Bixby settings;

• To provide customized content and personalized services based on your past activities on Bixby (“Personalized Bixby”) when you enable this feature;

• If you have enabled Customization Service, use the information to provide customized content and recommendations. More details are available in the Customization Service privacy notice (available at https://terms.samsungconsent.com/j5p7ll8g33/CZSVC/1.2/USA/USA_eng.html);

• To provide promotions and offers by way of direct marketing communications, only where you have given us your separate consent;

• To analyze our products and services to help us better understand our customers in order to offer the most relevant communications, services, and experiences to you;

• To ask you for your opinions on our products and services and to carry out customer surveys, with your separate consent if required;

Audio Recordings

If you decide to opt in for review, including human review, of your audio recordings to troubleshoot and respond to any issues related to your use of Bixby, we will store your audio recordings associated with your identifier for a period of one month.

After one month, your audio recordings will be disassociated from any identifier and stored for a total period of one year. These recordings are pooled with other recordings, and a small percentage of those recordings may be selected for review to improve and train Bixby. Some of these recordings may contain personal information.

You can opt in by going into the Bixby settings > Privacy settings > Allow audio recording review. You can withdraw your consent at any time through these settings.

This opt-in will apply to the Samsung account you use to sign in to Bixby, and will apply to any device that you sign in to with that Samsung account. If you do not opt in to the review of your audio recordings, your audio recordings will be deleted once your requested command has been provided. This also means there will be no audio recordings to help you troubleshoot or resolve any issues related to your use of Bixby.

Personalized Bixby

Personalized Bixby is designed to serve content and responses tailored to you while using Bixby on your device. Opt-in to Personalized Bixby will apply to the Samsung account you use to sign in to Bixby, and will apply to any device that you sign in to with that Samsung account. Personalized Bixby may deliver customized content and responses based on your preferences and choices made and service usage patterns while using Bixby, including sending you notifications that introduce useful commands, new features or events. Audio commands that use your device’s geolocation will also be used to remember your preferred locations. Bixby offers you Personalized Bixby as shown in the following examples:

• When you use Bixby, there are times when your request may output several choices. For example, if you ask for the weather in Georgia, Bixby may ask whether you mean the country of Georgia or the state of Georgia. As you make the same choice over time, Bixby will learn which Georgia you mean and will automatically select the Georgia you have chosen continuously over time.

• As you continue to use Bixby, it will ask about what you like and learn what you prefer. As Bixby learns what you like, it will ask you whether you prefer something. You may then set your preferences, which Bixby will remember for future use. For example, if you search for nearby restaurants, Bixby may ask if you prefer Italian restaurants. If you indeed prefer Italian restaurants, you may set this as a preference.

• Bixby will collect and analyze information on how you use Bixby, including which services you use frequently and when you use Bixby, and usage information related to Samsung and third-party apps and services and devices connected to Samsung apps and services, such as registered devices within Samsung apps or phone numbers stored in contacts. As you use Bixby over time, Bixby will learn your usage patterns and will recommend appropriate voice commands and various services or functions which you may be interested in.

If you have opted in to the Samsung Customization Service on your mobile device, Personalized Bixby and the Samsung Customization Service will work together to provide an even better Personalized Bixby service on your mobile device. To learn more about our privacy practices with respect to the Samsung Customization Service, please visit Customization Service in the Samsung account settings.

Opting out of Personalized Bixby and the Samsung Customization Service

You may opt out of Personalized Bixby by visiting the Bixby settings on your device and selecting Personalized Bixby.

If you have enabled the Customization Service on your mobile device and allowed the Customization Service to access your Bixby data, the Customization Service will continue to collect your Bixby data on your mobile device to provide you with customized content, in accordance with the Customization Service Privacy Notice. This information will not, however, be used to provide customized content and responses through Bixby. You can opt out of the Samsung Customization Service by going into your general settings menu on your mobile device.

We use and combine the information we collect about you from Bixby, other Samsung services or Samsung features we offer, devices, or other third party sources to provide you with a better experience. For example, you can use your Samsung account details to sign in to Bixby on multiple Samsung devices you may own. We also use the information you provide directly or through other sources as described above to provide content you may like or that you’ve personalized on Bixby, such as, for example, when you prefer a certain type of restaurant, listing that type of restaurant when you search for restaurants near you.

Information Sharing

As stated above, this Privacy Notice supplements the Samsung Privacy Policy (available at https://www.samsung.com/us/account/privacy-policy), which describes our information sharing practices.

How Do We Keep Your Information Secure?

We take data protection seriously. We have put in place physical and technical safeguards to keep your information secure. However, please note that although we take reasonable steps to protect your information, no website, internet transmission, computer system, or wireless connection is completely secure.

State Law Privacy Rights

If you reside in certain states, you may have rights and choices concerning personal information. All residents in the U.S. may also have rights and choices concerning personal information.

How Long We Keep Your Information

As stated above, this Privacy Notice supplements the Samsung Privacy Policy (available at https://www.samsung.com/us/account/privacy-policy), which describes our information retention practices.

How to Submit a Privacy Rights Request

To submit a privacy rights request, such as an access, deletion or correction request, go to our US Privacy Portal website (https://www.samsung.com/us/privacy/) or call us at 1-800-SAMSUNG (1-800-726-7864).

You may request details from us about the information we have collected from and about you including the categories of personal information we have collected about you, such as device information, basic usage information and voice information.

Updates to This Privacy Notice

We may update this Privacy Notice from time to time and without prior notice to you to reflect changes in our personal information practices with respect to Bixby. We will provide you with advanced notice of any material changes by notifying you through Bixby or email if we have one. We will provide you with advanced noticed of any material changes by notifying you through the Service or email if we have one. We will indicate at the top of this Privacy Notice when it was most recently updated.

Bixby U.S. Privacy Notice for Minors

We (Samsung Electronics Co., Ltd. and our related companies) care about your privacy. This Privacy Notice will explain how we handle information about you when you use Bixby (“Bixby”). If you have any questions while reading this Privacy Notice, we recommend you sit with a parent or guardian to help you review and understand this Privacy Notice.

Please note that this is a simplified version of the Bixby U.S. Privacy Notice made for minors (those under 18 years of age), not a substitute.

Information We Get

When you use Bixby, we may collect, and you might share with us, certain information about you. These include:

Information You Choose to Give Us

• Samsung account information: such as account ID, nickname; and

• Information that lets us learn more about you: such as name, gender, email, date of birth, and phone number.

Information We Get Automatically

• Information about what you’re using: This is information about your device and other devices not from Samsung connected to Bixby, like what kind of device you are using and how you are using it, what settings you have turned on or off, and information that lets us know which device is yours (these are called identifiers);

• Information about how you use Bixby: How, when, and for how long you use Bixby and other apps and services and the devices you connect to Bixby. We also collect information about when you ask Bixby to do something or answer Bixby, including with your voice. We also collect responses from Bixby and other apps and services, which might include information like what app or service was used, what websites you visit, and information saved on your device like your contact lists and calendar entries.

• Information about where you are: We may collect information about your location, including by using Bluetooth and Wi-Fi. If you (or your parent or guardian) allow us, we may collect information about your location to tell us better and more exactly where you are (this is called geolocation). Your device will let you know when we are collecting your geolocation.

• Information about the contents you allow to Bixby read aloud: When you use the read-aloud feature, the content you want to hear, like messages or emails, will be collected and processed to be read to you. After it's read, the content will be deleted. You'll need to give permission before anything is collected for this feature.

We may also collect other information about you, your devices and apps, and how you use Bixby when you allow us. When we do, we will explain it to you.

How We Use the Information

We may use the information we get through Bixby for the purposes below. We may not use your information for some of the purposes depending on how old you are. For example, if you’re under 13 we won’t use your information for personalized ads or marketing.

• make sure it is you who is using Bixby;

• let you use Bixby;

• make Bixby better, including by asking your opinion;

• if you have turned on Personalized Bixby, show and provide you with features you might like depending on how you use Bixby.

• if you have turned on Customization Service, use your information to provide customized content and recommendations. More details are available in the Customization Service privacy notice (available at https://terms.samsungconsent.com/j5p7ll8g33/CZSVC/1.2/USA/USA_eng.html);

• let you ask questions and give instructions through or about Bixby and respond to them; and

• with your permission, to send you marketing by email or push notifications.

Audio recordings (your voice recordings)

When you make a command using your voice, this voice data will be erased once we provide your request. If you turn on Audio recording review, we hold onto the data for one month to help you and respond to any issues.

After one month, any identifier connected to your voice data is removed and we keep this voice data for up to one year. During this time, the voice data will be used to review and improve Bixby.

You can turn this on in the Bixby settings > Privacy settings > Allow audio recording review. When you do, if you sign in to another device with your Samsung account and use Bixby, your voice data from that device will also be used to help improve Bixby. You can turn this off in the same settings.

Personalized Bixby

If you turn on Personalized Bixby, Bixby will provide you with responses and content (including notifications about useful commands, new features, or events) depending on when and how you use Bixby, including your preferences and choices you have made, how you use Samsung and other company apps and services and devices connected to them. Even your preferred locations will be remembered from your requests that used location.

For example, if you ask Bixby to show you restaurants or ask for the weather, Bixby will remember what you choose or prefer. So if you like Italian restaurants or keep asking for the weather for a specific city, Bixby will remember this to provide you with better responses and recommendations.

Also, if you have turned on Customization Service, Personalized Bixby and Customization Service will work together to provide even better results.

If you turn on Personalized Bixby and sign in to another device with your Samsung account and use Bixby, that device will also have Personalized Bixby turned on.

Turning off Personalized Bixby and Customization Service

You can turn off Personalized Bixby in the Bixby settings. However, if Customization Service is turned on, even if you turn off Personalized Bixby, your Bixby data will be used to provide the Customization Service. You can turn off Customization Service in your device’s general settings.

Sharing Your Information

We may share your information with other Samsung companies, business partners, and service providers that help us run Bixby. Sometimes, we are required by law to share information for legal purposes, or public safety. Additionally, we may share your information when you give us permission or request it. If you don't understand, please ask your parent or guardian about the Who Do We Share Your Information With? section of our Privacy Policy (available at https://www.samsung.com/us/account/privacy-policy).

How Long We Keep Your Information

We don’t keep your personal information if we don’t need it. Your information will be kept for as long as it is needed to provide you with Bixby, as required by law (government rules) or contracts (promises we made to other companies), or only for as long as necessary for one of the purposes above.

Once it is no longer needed, we will either delete it or anonymize it (meaning we won’t know it’s your information).

What Can You Ask Us To Do With Your Information?

Depending on where you live, you (or your parent or guardian) have the right to ask us to:

- give you a copy of the information we have about you and in a way other devices can read this information;

- update or fix your information;

- delete your information;

- collect your information using a voice recognition feature.

You (or if you’re under 13 your parent or guardian) can make these requests by calling us at 1-800-SAMSUNG (1-800-726-7864) or by clicking here. If you ask us to delete or stop using your information, some parts of Bixby might not work as expected. Always talk to your parents or guardian if you are not sure.

Updates to This Privacy Notice

We may update this Privacy Notice from time to time. If we make significant changes, we will let you know before we update this Privacy Notice through Bixby or email if we have one. You can always see when we last made changes to this Privacy Notice by checking the date at the top.
